WA: Judge clears way for woman to sue obstetrician
A court has allowed a Victorian woman the right to sue her obstetrician for medicalnegligence after giving birth to a brain-damaged child six years ago.
Under the Limitations Act, such action usually has to begin within a year, but a sub-sectionallows for it to go ahead within six years if there was a delay because of a mistake orany other reasonable cause.
West Australian District Court judge JOHN WISBEY has ruled plaintiffs YVONNE JOYCEMCLENNAN and her son JACOB RIELY MCLENNAN can proceed with the case because of that section.
In May 1997, Ms MCLENNAN gave birth to JACOB in Kalgoorlie Hospital in the WA goldfields.
He suffered brain damage during his footling breach birth -- a birth where one or bothof the baby's feet engage into the birth canal before its head.
